I could be mistaken here as I have been before but sometimes charges are not filed until a full investigation is done.
When I had my accident in 1996 there were no charges filed against me until the accident reconstructionast and the other tests were finalized, then there were no charges filed. The newspaper print here read "charges pending further investigation" or somtehing like that.
I am not saying you are doing this, but some people are quick to judge a situation without knowing all of the facts or ever walking in the other pair of shoes. (me included on this)
After what I went through in July of 1996 I have learned to be careful about judging others when accidents occur.
I am sure the reason for no charges is because they have to send the blood in to check and see if he was intoxicated and if he was then I am sure that would make the offense more severe as it does in Kansas. If they charged him now before they get those test results back, he could plead to the lesser offense and not get what he deserves.
If this is true who cares if he was Drunk. If he's sober doing this $hit thats worse.
Florida Highway Patrol investigators said Lane was trying to pass two other vehicles on a double yellow-lined portion of A1A when his southbound 2006 Dodge Ram pickup collided with a northbound 1983 Yamaha moped.
It's been a lot of years since I was on the DWI squad but I remember back then that Florida was known for having lots of loop-holes in it's DWI laws. Don't know the laws there now, so we'll just have to wait and see what shakes out of the investigation.
Sorry, just tried to explain how the system works in most states. I would much rather have them take thier time and make sure the their t's are crossed, i's are dotted and put him away for along time. In Kansas he could only be charged with a misdemeanor unless there is alcohol involved then it becomes a felony. I am sure they didn't even bother with a breath tests cause in some courts they are easier to beat, so thats the reason for blood. Not making excuses cause I hope he goes to the pen for a long time, just trying to explain the process.
same withCalif.....you BAC is instant,,,,blow into a machine,,take a piss into a cup,,or get blood drawn,,,,,,,that is how they find drunk drivers.....So why wasn't he tested there.....In Calif,,they give you your choice of those 3 ways of testing you......How do they do it in FLa ?.....Just because he builds bikes and is a business owner ,doesnt give him any special treatment for murdering some one !!!!!,,,I wonder how many grandchildren will miss there grandfather because of him,,,,I say.......HANG HIS ARSE !!!!!!!......
