Just got a notice from Court (must have been sent from new-bike Buyer lists) so here's a "heads up" for anyone who might not be in the know yet: (Full litigation info appears at end of this post). 2 guys in CA filed a class-action lawsuit vs Honda re the GL1800 overheating problem. A proposed settlement has been reached. Any person who on Feb 17th 2004 owned a 2001, 2002 or 2003 GL1800 is automatically included as a Class Member Plaintiff in the suit. If you do nothing, you are entitled to receive the settlement benefits at no cost to you - in which case, you are effectively releasing Honda from any-all further claims.

You can elect to opt out as a Class Member & pursue H individually if you wish - or you can remain a Class Member but (at your own expense) raise an objection to the proposed settlement terms. In either case, you must do so via mail postmarked no later than 04-09-04, mailed respectively to Honda & Class Counsels (info below). The proposed settlement offers two forms of "relief" to Class Members:

(1) The (ongoing) voluntary campaign to replace the ECM (engine control module), inspect cylinder head coolant capacity, inspect L side radiator outlet, inspect/install coolant gauge sub-harness and pressure-test cooling system. This service is done ONLY IF THE OWNER REQUESTS IT.

(2) Under the proposed settlement, to all Class Members, Honda will offer a 2-YR EXTN OF THE ORIG FACTORY LIMITED WARRANTY ON THE ENGINE AND COOLING SYSTEM, EXCLUDING THE TRANSMISSION AND POWER TRAIN. THIS 2-YR LIMITED WARRANTY EXTN WILL COMMENCE AT THE EXPIRATION OF THE ORIGINAL LIMITED WARRANTY, OR AT THE EXPIRATION OF ANY PURCHASED HONDA PROTECTION PLAN EXTENDED WARRANTY. THE 2-YR LIMITED WARRANTY EXTN OFFERED IN THE PROPOSED SETTLEMENT WILL BE FULLY TRANSFERABLE.

The Court preliminarily approved the proposed settlement on 02-17-04. A "Fairness Hearing" is scheduled 04-26-04 for the Court to consider/determine if the proposed settlement and Class Counself fee's are fair and summarily approved by the Court. So, unless you wish to remain a Class Member and accept whatever settlement benefits might ultimately be approved by the Court, remember that you only have until 04-09-04 to mail out any notices of alternative intent/action.

(if you are electing to opt out as class member: a specific stmt of intent to exclude yourself i.e. "Please exclude me from the Settlement Class in the Gold Wing GL1800 Litigation") OR

(If you are electing to remain a Settlement Class Member but file an objection to the terms of the settlement, also include and and all factual and legal grounds, including and evidence and supportive documentation that you would like the Court to consider).
